We are committed to respecting your privacy. Sunday was built so that we never need to hold your family's information in the first place.

This Privacy Policy describes our practices regarding information relating to you ("Personal Information") in connection with the Sunday app for iPhone and iPad and the website at www.sunday.cooking (collectively, the "Services"), operated by Kirk Ouimet LLC (referred to as "Sunday," "we," "us," or "our").

1. Information We Collect

1.1. What the App Stores, and Where

Sunday has no accounts and no servers of ours that hold your content. Everything you add to the app is stored with Apple's iCloud service, under the Apple Account already signed in on your device:

We do not have access to any of this. It is not sent to us, and we could not read it if we wanted to. For that reason we do not treat it as information we collect.

1.2. What Happens on Your Device

Naming a dinner from its photo, writing a caption, tagging food, turning a spoken recipe into text and sorting it into steps all happen on your iPhone or iPad using Apple's on-device features. Your photos and recordings are not sent to us or to anyone else for this.

The app asks for permission before using the camera, the microphone, speech recognition or notifications, and uses each only for the feature you chose.

1.3. Information You Provide to Us

That is the only Personal Information you can provide to us directly. The app has no sign-up, no profile and no forms that send information to us.

1.4. Information We Receive Automatically

2. How We Use Information

We use the limited information described above only for the following purposes:

We do not use Personal Information for advertising, marketing, profiling or research, and we do not use your content to train any model. We have no access to your content.

3. Disclosure of Information

We do not sell Personal Information, and we do not share it for advertising. We may disclose the limited information we hold in the following circumstances:

3.1. Vendors and Service Providers

We use a small number of service providers to operate the Services, namely a hosting provider for the website and the settings file, and an email provider for the messages you send us. These parties process information only in the course of performing their services for us.

3.2. Business Transfers

If we are involved in a merger, sale, reorganization or transition of the Services to another provider, the limited information we hold may be transferred to a successor as part of that transaction. Your dinners, photos and ratings are not ours to transfer; they remain in your iCloud account.

3.3. Legal Requirements

We may disclose the information we hold if required to do so by law or in the good faith belief that such action is necessary to comply with a legal obligation, to protect and defend our rights or property, to detect or prevent fraud or other illegal activity, or to protect the safety of our users or the public. Because we do not hold your content, we cannot disclose it.

3.4. People You Share With

When you invite people to your family in Sunday, the dinners you share are visible to them through Apple's iCloud sharing. Be sure you trust the people you invite. Your star ratings are never shared.

4. Your Rights

Depending on location, individuals may have certain statutory rights in relation to their Personal Information, such as the right to access, correct, delete or restrict the processing of it, the right to data portability, the right to withdraw consent, the right to object, and the right to appeal a decision we make about a request.

Because your Sunday content lives in your own iCloud account, you exercise most of these rights directly, without asking us:

For Communication Information, such as an email you sent us, contact us and we will provide, correct or delete it. We may need to confirm that the request comes from the address that sent the message.

5. Additional U.S. State Disclosures

The only categories of Personal Information we collect are identifiers and communication contents that you send us by email, and network activity information in the form of Log Data. We disclose these only to the service providers described above, and as required by law.

To the extent provided for by local law and subject to applicable exceptions, individuals may have the following privacy rights in relation to their Personal Information:

We do not sell Personal Information or share it for cross-contextual behavioral advertising, and we do not process sensitive Personal Information for inferring characteristics about consumers.

5.1. Exercising Your Rights

To the extent applicable under local law, you can exercise the privacy rights described in this section by contacting us.

5.2. Verification

Sunday has no accounts, so we verify a request by confirming that it comes from the email address associated with the information. If we cannot verify a request, we will not be able to honor it.

5.3. Authorized Agents

You may also submit a rights request through an authorized agent. If you do so, the agent must present signed written permission to act on your behalf, and we may ask you to confirm the request yourself.

5.4. Appeals

Depending on where you live, you may have the right to appeal a decision we make relating to requests to exercise your rights under applicable local law. To appeal, reply to our decision or contact us.

6. Children's Privacy

Sunday is a general-audience app made for families. It is not directed to children, and it does not collect Personal Information from anyone who uses it, including children. A child who uses Sunday does so through an Apple Account and iCloud, which are governed by Apple's terms and family settings.

We do not knowingly collect Personal Information from children under 13. If you believe a child has sent us Personal Information, for example by email, please contact us so we can delete it.

iCloud, iCloud sharing and the on-device features Sunday relies on are provided by Apple and are governed by Apple's Privacy Policy. Apple, not Sunday, stores and secures the content you keep in iCloud.

Our Services may contain links to other websites not operated or controlled by us. Information you share with those websites is governed by their respective privacy policies. By providing these links we do not imply that we endorse or have reviewed these sites.

8. Security and Retention

The most important protection in Sunday is that we do not hold your content: it stays on your devices and in your iCloud account, protected by Apple's security and by the passcode and Apple Account on your device.

For the limited information we do hold, we use commercially reasonable measures to protect it from loss, misuse and unauthorized access. However, no Internet or email transmission is ever fully secure or error free. In particular, email sent to or from us may not be secure, so please take care in deciding what you send us.

We keep Communication Information only for as long as we need it to answer you and for legitimate purposes such as resolving disputes or complying with our legal obligations. Log Data is kept by our hosting provider for a limited time under its own retention practices. Your Sunday content is kept in your iCloud account for as long as you choose to keep it.

9. International Users

Kirk Ouimet LLC is based in the United States. If you email us or load our website, the limited information described in this Privacy Policy may be processed in the United States and in other countries where our service providers operate. Your Sunday content is stored by Apple in iCloud under your arrangement with Apple.

9.1. Legal Basis for Processing

Where a legal basis is required, we rely on the following:

9.2. Data Transfers

Where required, we will use appropriate safeguards for transferring Personal Information outside of certain countries, and we will only transfer Personal Information pursuant to a legally valid transfer mechanism.

10. Changes to this Privacy Policy

We may update this Privacy Policy from time to time. When we do, we will post the updated version on this page with a clear effective date. We encourage you to review this Policy periodically.
